LaMoille defendant in Texas tax-fraud case dies

Prosecutors in San Antonio have dropped a tax evasion investigation against a LaMoille man after learning of his June 23 death.

Kevin James Scully, 48, was found in his car in his LaMoille home's garage and later died at Mendota Community Hospital.

La Salle County Coroner Jody Bernard told The Times on Thursday the cause of Scully's death was carbon monoxide poisoning and the manner was suicide.

According to reports in the San Antonio Express-News, Scully was facing charges of filing false tax returns with his uncle, Robert Warren Scully. Both were named in a recent nine-count indictment filed by the U.S. attorney's office in San Antonio.

From April 2001 to July 2009, prosecutors allege the Scullys ran a scheme in which they used four shell companies in Thailand to inflate the cost Gourmet Express paid for shrimp and then siphoned off those excess costs to various bank accounts they used for personal expenses.

It also contends the pair filed false personal tax returns for themselves and their wives in 2003, 2004, 2005 and 2006 and that they caused a false return to be filed on behalf of the San Antonio-based frozen food company for 2006 taxes.

While the total amount of under-reported income and other claims has yet to be tabulated, federal attorneys believe the tally will reach the multimillion-dollar level.

The prosecution against Robert Scully, who was arrested in 2010 in Santa Cruz, Calif., continues.
